Green Cards

There are many ways that you can apply for your green card (lawful permanent residence) in the United States.  The most common ways to apply are through a family member or through an employer.  Ms. Baskin provides individualized attention to each case and explores all options to consider the best solution for each client.

Family Based Green Cards

Rachel Baskin provides assistance to clients who wish to sponsor family members.

United States Citizens can sponsor:

  • Fiancés/Fiancées

  • Spouses

  • Children

  • Parents

  • Siblings

Lawful Permanent Residents can sponsor:

  • Spouses

  • Unmarried Children

U.S. Citizens and lawful permanent residents can file petitions for family members who are either inside the United States or who are waiting outside the United States.  Rachel Baskin can assist in filing cases with United States Citizenship and Immigration Services (USCIS) in the United States as well as with U.S. Consulates abroad.

The processing times for these applications vary greatly, and can change each month.  Moreover, a change in status (such as a lawful permanent resident becoming a citizen, or an unmarried child getting married) can greatly affect a petition.  It is important for the petitioning relative (the sponsor) to be aware of these changes and the impact that they will have on the case.

Employment Based Green Cards

Similar to temporary work visas, in order to gain lawful permanent residence in the United States based on employment, you must have an employer who is willing to sponsor you.  However, there are some categories under which you can sponsor yourself.  Rachel Baskin provides assistance to foreign nationals who wish to obtain their lawful permanent residence through employment.

EB-1: Priority Workers

  • Individuals with extraordinary ability in the arts, sciences, education, business or athletics.  You may be eligible to file this petition without a prospective employer.

  • Outstanding Professors or Researchers

  • Managers or Executives to be transferred to the United States

EB-2: Professionals

  • Individuals with exceptional ability in the arts, business or science

  • Professionals with an Advanced Degree or the Equivalent

  • Physicians intending to practice medicine in an underserved area

  • Professionals whose immigration would be in the national interest of the United States (National Interest Waiver Cases).  You may be eligible for this type of petition without a prospective employer.

EB-3: Skilled or Professional Workers

  • Professionals with a Bachelor’s Degree or Equivalent

  • Individuals with two years of experience with skilled work

  • Other Workers

EB-4: Special Immigrants

  • Religious Workers

EB-5: Investor Visas

The process of filing for a green card through an employer can be a long process for both the employer and the foreign national.  Ms. Baskin explores all options with her clients to make the process as simple as possible for the employer, the foreign national and his/her family members.
